L’appropriation locale du discours autochtone : stratégie d’opposition et innovations territoriales dans le conflit foncier de Chocholá (Mexique)

International audienceSince the constitutional reform of 1992, which allows the privatization of ejidal lands, investment projects have multiplied in Mexican ejidos, sometimes giving rise to conflicts. Under the influence of international organizations, ethnicity has become a field of political mobilization of rural populations opposed to these private projects. Based on the study of the Chocholá land conflict in Yucatán, regarding the sale of an ejidal plot for the establishment of a lime factory, this article proposes to examine the process and effects of local ownership of the discourse on the rights of indigenous peoples. It shows that the circulation of indianist discourse involves a reframing of the conflict in terms of collective issues, but that it is also the subject of a territorial translation specific to local concerns. The territorial innovations developed are part of the historical logic of negotiation of the legal framework in the (attempted) production of rules that frame the construction and government of Mexican rural territories. However, they distinguish themselves by seeking to develop “a localized legal order”, that is to say a local rootedness of the law, which makes Chocholá a laboratory in rural governance in the era of indigenous claims.Depuis la réforme constitutionnelle de 1992, qui autorise la privatisation des terres ejidales, les projets d’investissement se sont multipliés dans les ejidos mexicains, donnant parfois lieu à des conflits. Sous l’influence des organisations internationales, l’ethnicité est devenue un champ de mobilisation politique des populations rurales opposées à ces projets privés. À partir de l’étude du conflit foncier de Chocholá, au Yucatán, relatif à la vente d’une parcelle ejidale pour l’installation d’une usine à chaux, cet article examine le processus et les effets de l’appropriation locale du discours sur les droits des peuples autochtones. Il montre que la circulation du discours indianiste procède à un recadrage du conflit en termes d’enjeux collectifs, mais qu’il fait également l’objet d’une traduction territoriale propre aux préoccupations locales. Les innovations territoriales élaborées s’inscrivent dans les logiques historiques de négociation du cadre légal et dans la (tentative de) production de règles qui encadrent la construction et le gouvernement des territoires ruraux mexicains. Cependant elles s’en distinguent en cherchant à élaborer « un ordre juridique localisé », c’est-à-dire un enracinement local du droit, ce qui fait de Chocholá un laboratoire en matière de gouvernance rurale à l’ère des revendications autochtones
