International audienceHuman rights play a key role in climate matters, both procedurally and substantively. However, designed to meet certain normative needs, they have temporal limits (the violation must be effective, the remedy does not aim to prevent it) and spatial limits too (extraterritoriality implies an effective power in the territory where the victim is located). Consequently, these rights are not equipped to deal with global challenges and cannot absorb all the demands in this area; seeking to extend them means running the risk of diluting and weakening them. Therefore, effective and efficient climate protection implies the recognition of collective and intertemporal rights: the rights of ma,kind. These rights are the basis of the actio popularis and allow for recourse even in the absence of an individualisable injury.Les droits de l'homme jouent un rôle-clé en matière climatique, tant sur un plan procédural que substantiel. Toutefois, pensés pour répondre à certains besoins normatifs, ils présentent des limites temporelles (la violation doit être effective, le recours ne vise pas à la prévenir) et spatiales (l’extraterritorialité implique un pouvoir effectif sur le territoire où se trouve la victime). Dès lors, ces droits ne sont pas armés pour faire face aux défis globaux et ne peuvent absorber toutes les demandes dans ce domaine ; chercher à les étendre, c’est prendre le risque de les diluer et de les fragiliser. Aussi, une protection efficace et effective du climat implique de reconnaître des droits collectifs et intertemporels : des droits de l’humanité.
