Legal teaching: evaluating learning from a theory/practice association experience.

The present work is centered on learning, in a juridical context, and constitutes a qualitative investigation that assessed a teaching methodology, characterized by an association between theory and practice, in a short course on Procedural Penal Law. The teaching experience took place in the Law Course of Fundação Universidade Federal do Rio Grande (FURG), in which the author works as a lecturer in Procedural Penal Law. The investigation was aimed at analyzing the elements that, according to the author, make such methodology effective, examining its impact and offering an opportunity for a discussion and possible reformulations of it. The theoretical basis used was built from specific aspects of Vygotsky´s Socio-Historical Theory - such as the system of concept formation, the mediating role of teachers and imitation as a teaching device - as well as from the studies of post-vygotskians, such as Gordon Wells, who has developed the concept of Inquiring Community. Besides these, the ideas of Boaventura de Sousa Santos about the Paradigmatic Transition in Education and of Donald Schön and Isabel Alarcão on the Reflexive Teacher were also of extreme relevance for this investigation. The evaluation of the course was carried out through observations (field notes) by the teacher/researcher and through evaluations by the students (written questionnaire and group discussion). It allowed the conclusion that the association between theory and practice in Law teaching was beneficial to the students in as much as it generated a greater degree of autonomy and assurance in relation to the practical aspects of the content that has been studied during the course, besides increasing their interest in it and their will to seek new information and new experiences related to it. The evaluation of the experience, suggests, as well, that the students learned a good deal and that their learning process was made more potent by the constitution of an inquiring community in the classroom: students were given incentives to contribute to the discussion and their contributions were valued. The work also illustrates the processes and benefits sprang from the reflexive posture assumed by the teacher.Este trabalho tem como enfoque principal a aprendizagem, no contexto do ensino jurídico, e é constituído por uma pesquisa qualitativa que avaliou uma metodologia de ensino caracterizada pela associação teoria/prática em um minicurso sobre Direito Processual Penal. A experiência de ensino foi realizada com um grupo de alunos do Curso de Direito da Fundação Universidade Federal do Rio Grande (FURG), instituição na qual a autora leciona a disciplina de Direito Processual Penal. A investigação visou a analisar os elementos que tornam essa metodologia, segundo a autora, bem sucedida, examinando seu impacto e abrindo um espaço para discussão e possíveis reformulações. O embasamento teórico utilizado foi construído a partir de aspectos particulares da Teoria Sócio-Histórica de Vygotsky - como o sistema de formação de conceitos, o papel mediador do professor e a imitação como instrumento de aprendizagem - bem como a partir dos estudos de autores pós-vygotskyanos, como é o caso de Gordon Wells, que desenvolveu o conceito de Comunidade de Indagação. Além desses, também as idéias acerca da Transição Paradigmática na Educação de Boaventura de Sousa Santos e aquelas sobre o Professor Reflexivo - de Donald Schön e Isabel Alarcão - foram de extrema relevância na elaboração da pesquisa. A avaliação do minicurso foi realizada a partir das observações da professora/pesquisadora (notas de campo) e de avaliações dos alunos (questionário escrito e discussão grupal). Ela permitiu concluir que a associação teoria/prática no ensino do direito trouxe, como benefício, um maior grau de autonomia e segurança aos alunos, no que tange à prática dos procedimentos teóricos estudados em aula, além de despertar o seu interesse pelo conteúdo trabalhado e a busca de novas informações e experiências relacionadas com ele. A avaliação da experiência também sugere que os alunos tiveram um ótimo aproveitamento em termos de aprendizagem, que foi potencializado, também, pela constituição de uma comunidade de aprendizagem em aula: nela, a contribuição dos alunos foi incentivada e valorizada.
