La reforma de capacidad jurídica: algunos apuntes teóricos sobre su justificación

The legal capacity reform adopted in Peru provided a stepping stone made significant inroads for the mainstream and equal recognition before the law for persons with disabilities; it entailed the possibility to fully exercise their fundamental rights for this population. Likewise, it involves a profound shift on theoretical and political concepts around legal capacity, which should be addressed by the civil law and the related disciplines. Considering that we are in the implementation process of this new legal framework, it is compelling to carefully analyze the theoretical shift behind the legal in order to facilitate the understanding of its real magnitude and recognize the turning points in our legal theory. Otherwise there is a risk that this change will generate in our legal reality an inconsistent and uniform effect, in which it is not possible to materially achieve the new recognitions and freedoms.La última reforma peruana en materia de capacidad jurídica, plasmada en el Código Civil Peruano, abrió paso al reconocimiento de este derecho en condiciones de igualdad para el colectivo de personas con discapacidad. Este reconocimiento formal tiene un particular impacto en aquellas personas con discapacidad intelectual y psicosocial que habían sido tratadas históricamente como objetos y no como sujetos de este derecho. Este cambio normativo trae consigo un cambio profundo de los conceptos teórico-políticos en torno a la capacidad jurídica que deben ser abordados la dogmática civil y las disciplinas comprometidas. Encontrándonos en el proceso de aplicación de esta nueva legislación, consideramos de trascendental importancia observar con detenimiento el cambio teórico detrás de la reforma en aras de facilitar la comprensión de su real magnitud y reconocer los puntos de inflexión en nuestra teoría jurídica. Pues de lo contrario se corre el riesgo de que este cambio genere en nuestra realidad jurídica un efecto no coherente ni uniforme, en el que no sea posible alcanzar materialmente los nuevos reconocimientos y libertades
