Abstract: Marriage is a strong bond that is described in al-Qur’an as mithaqan ghalizan, an extraordinary bond (solemn pact). Therefore, to reach the validity of marital contract, there are some requirements to fulfill. Among the Muslim scholars of the Islamic thoughts, they all agree to the requirements of the validity of marital contract required but one. It is about a guardian of marriage for woman. Among Syafi’iyyah Islamic thought, a guardian of marriage for woman is an absolute requirement that must be met for the sake of a validity of marriage.
