Mahkamah Syar'iyah dalam Perspektif Politik Hukum Indonesia

The Law of Judicial Power, applies equally to all citizens in the Judicial process, but for the Province of Aceh it is treated differently. The indication is the existence of the Syar'iyah Court (Special Court for Muslims) based on Law Number 18 Year 2001, whereas in Aceh Province there are very many citizens who are Catholic, Protestant and Other, so that it seems disharmony in the judicial power system in Indonesia. The results showed that the establishment of the Syar'iyah Court was part of a strategy in special autonomy in Aceh Province, so that most of the people in the Province of Aceh turned out to support and not contradict the existence of the Syar'iyah Court Institute, since it was established and formalized on March 3, 2003 by the Chief Justice Supreme Republic of Indonesia. The Syar'iyah Court stands in existence, side by side with the General (State) Judiciary, the State Administrative and Military Courts which apply equally to all Acehnese citizens. Granting special autonomy to the Province of Aceh in line with the Decree of the Prime Minister of the Republic of Indonesia number; 1 / Mission / 1959 signed by Mr. Hardi as Deputy Prime Minister / Chairperson of the Central Government (Jakarta) delegation to Aceh Province.   Abstrak: Undang-undang tentang Kekuaasaan Kehakiman memberlakukan sama semua warga Negara dalam proses Peradilan, akan tetapi untuk Provinsi Aceh diberlakukan berbeda. Indikasinya adanya Mahkamah Syar’iyah (Peradilan khusus bagi orang Islam) berdasarkan Undang-undang Nomor 18 Tahun 2001. Padahal di Provinsi Aceh sangat banyak warga negara yang beragama Khatolik, Protesten dan beragama Lain, sehingga terkesan disharmoni dalam system kekuasaan kehakiman di Indonesia. Hasil penelitian menunjukan bahwa pendirian Mahkamah Syar’iyah ini adalah sebagian strategi dalam otonomi khusus di Provinsi Aceh, sehingga sebagian besar masyarakat di Provinsi Aceh ternyata mendukung dan tidak mempertentangkan keberadaan Lembaga Mahkamah Syar’iyah, sejak didirikan dan diresmikan tanggal 03 Maret 2003 oleh Ketua Mahkamah Agung Republik Indonesia. Mahkamah Syar’iyah berdiri eksis, berdampingan dengan Lembaga Peradilan Umum (Negeri), Peradilan Tata Usaha Negara dan Peradilan Militer yang berlaku sama bagi semua warga masyarakat Aceh. Pemberian otonomi khusus kepada Provinsi Aceh sejalan dengan Keputusan Perdana Menteri Republik Indonesia Nomor: 1/Missi/1959 yang ditandatangani oleh Mr. Hardi selaku Wakil Perdana Menteri / Ketua utusan Pemerintah Pusat (Jakarta) ke   Provinsi Aceh
