Derogation clauses of international human rights instruments: protecting rights at the maximum possible extent in times of crisis

This article aims to analyse the rights’ derogation clauses foreseen in the International Covenant on Civil and Political Rights and the European Convention on Human Rights. The several conditions that a State must fulfil to legitimately derogate from its obligations under these instruments in times of crisis will be studied and problematized, considering the existent jurisprudence. Finally, the problem of consequential derogations will be discussed, bearing in mind the experience of human rights’ suspensions during the 2020 pandemic crisis.Este artigo tem como objetivo analisar as cláusulas de derrogação de direitos humanos previstas no Pacto Internacional sobre Direitos Civis e Políticos e na Convenção Europeia de Direitos Humanos. As várias condições que um Estado-Parte deve cumprir, em contextos de crise, para poder suspender de forma legítima os direitos garantidos por estes instrumentos serão estudadas, de forma crítica, à luz da jurisprudência pertinente. Por fim, será analisada a questão das “derrogações consequentes”, tendo em conta as experiências de suspensão dos direitos humanos levadas a cabo durante a crise pandémica de 2020
