This article aims to analyse the rights’ derogation clauses foreseen in the International Covenant on Civil and Political Rights and the European Convention on Human Rights. The several conditions that a State must fulfil to legitimately derogate from its obligations under these instruments in times of crisis will be studied and problematized, considering the existent jurisprudence.
