Lo scudo di Achille. Il processo come archetipo di pace The Achilles’ shield. The trial as archetype of peace

Abstract (ENG): In the eighteenth book of Homer's Iliad, the first representation of the trial in Western culture appears on the Achilles’ shield, forged by Hephaestus, where the competitive spirit of classical Greece is manifested. The scene described on the hero’s aegis is an extraordinary anticipation of the fair administration of justice, the legal structure of which is exhibited at least in four fundamental steps: the contestation of the lawsuit; the dispute between the parties; the proof of the facts; the third party's judgment. The trial is the most important phenomenon of the city of peace, in which the culminating moment of judgment is depicted. The image indicates the legal and social order of the polis, which originates from the crisis of the Mycenaean palatial civilization and from the urban aggregation of villages and countryside, developing a political model that multiplies and lives in the principle of its continuous transformation. The circular shape of Achilles’ shield constitutes an interpretative metaphor of the social life of the Greek polis and of the pacifying structure of the trial, which draws its own conflictual and conciliatory nature at the same time from the epic genesis of the mythical tale and from the dialectical conscience of the Homeric hero. Abstract (ITA): Nel diciottesimo libro dell’Iliade di Omero, compare la prima rappresentazione del processo nella cultura occidentale sullo scudo di Achille, forgiato da Efesto, dove si manifesta lo spirito agonistico della Grecia classica. La scena descritta sull’egida dell’eroe è una straordinaria anticipazione dell’equa amministrazione della giustizia, la cui struttura giuridica si esibisce in almeno quattro momenti fondamentali: la contestazione della lite; il contraddittorio tra le parti; la prova dei fatti; il giudizio del terzo. Il processo è il fenomeno più importante della città della pace, nella quale viene raffigurato il momento culminante del giudizio. L’immagine indica l’ordine giuridico e sociale della pólis, che trae origine dalla crisi della civiltà palaziale micenea e dall’aggregazione urbana dei villaggi e delle campagne, sviluppando un modello politico che si moltiplica e che vive nel principio della sua continua trasformazione. La forma circolare dello scudo di Achille costituisce una metafora interpretativa della vita sociale della pólis greca e della struttura pacificante del processo, che attinge la propria natura conflittuale e ad un tempo conciliativa dalla genesi epica del racconto mitico e dalla coscienza dialettica dell’eroe omerico
