O valor das palavras no processo penal brasileiro

The present work seeks to identify the judicial value of the manifestations of those involved in the criminal process, specifically confronting the version of the offended person and the offender, when there is no other evidence to confirm the history presented in criminal court, specifically in the area of domestic violence. It addresses the premises that underpin the procedural evidence under the mantle of the current constitutional stage, in order to understand the legal nature and the character the manifestations of the victims and the offenders in the criminal process, which its positioned away from a testimonial evidence. It presents the Judicial Courts positions and the view of the theoretical scholars on the subject.O presente trabalho busca identificar o valor probatório da palavra dos envolvidos no processo penal, confrontando, especificamente, a versão da pessoa ofendida com a do acusado, quando ausentes outras provas a confirmar a história apresentada em juízo criminal, especificamente na seara de violência doméstica. Aborda as premissas que alicerçam as provas processuais sob o manto do atual estágio constitucional, a fim de se buscar entender a natureza jurídica das manifestações da vítima e do acusado no processo penal, afastando-as do valor probatório correspondente a uma prova testemunhal. Apresenta as características das palavras dos envolvidos em feitos de violência doméstica contra a mulher, sob o enfoque da parcialidade e, quando isoladas nos autos, confronta-as. Apresenta posicionamentos dos Tribunais acerca da valoração da palavra, bem como retoma algumas discussões teóricas sobre o assunto
