L'Etat et l'invention. Une comparaison franco-allemande des cadres de la propriété industrielle à la fin du XIXè siècle.

The history of patent systems suggests that protecting invention, which was supposed to encourage economic progress, belonged to the realm of sovereignty. Indeed, in the name of the general interest, the State promotes the industry by preserving inventors' rights. This paper compares two patent systems, the French and German ones, in order to analyze two ways of regulation at the end of the nineteenth century. With the United Kingdom and the United States, France developed a modern patent legislation during the Revolution. After being changed in 1844 under the constraint of the first industrial revolution, the French patent legislation remained surprisingly stable for over a century. German law differed in many ways: by adopting a new law in 1877 Germany developed an effective system based on the examination of patents, which did not exist in France. The differences between the two laws reflect different modes of representing industry and inventors' interests. While in Germany big industry – and particularly the chemical one – influenced directly the patent legislation, the involvement of industry was much more restrained in France. In practice, institutions devoted to regulate the patent system differed too. While Germany was developing in Berlin an efficient patent office, France had difficulties in restructuring its patent system despite the creation of the new patent office in 1901. On the eve of World War I, reforms of the French patent system were generally inspired by the German one. These attempts remained unsuccessful insofar as French liberal legacy was still significant.L'histoire de la propriété industrielle, réduite ici au brevet, souligne le caractère quasi-régalien de la protection de l'invention, censée encourager le progrès économique. En effet, au nom de l'intérêt général, l'État assure la promotion de l'industrie tout en préservant les droits de l'inventeur. Étudier les modalités d'intervention de l'État dans l'économie suppose donc que l'on se penche un tant soit peu sur l'évolution d'un aspect trop ignoré de la réglementation économique. Une comparaison franco-allemande est, en la matière, riche d'enseignements. La France possède en effet dans ce domaine l'image d'un pays pionnier qui, dès 1791, se dote d'une législation moderne. Profondément modifiée en 1844 sous la contrainte de la première révolution industrielle, la législation française sur les brevets d'invention s'avère d'une étonnante stabilité pendant plus d'un siècle. Quant à elle, la législation allemande se démarque sur bien des points : avec l'adoption d'une loi nouvelle en 1877 l'Allemagne se dote d'un dispositif efficace reposant sur l'examen préalable, inexistant en France. Les divergences entre les deux législations reflètent des modes différents de représentations des intérêts de l'industrie et des inventeurs auprès de l'État. Alors qu'en Allemagne la grande industrie - et notamment l'industrie chimique - pèse de tout son poids pour influencer la législation des brevets, l'implication des industriels dans ces débats est beaucoup plus timide en France. À cela s'ajoutenr également des contrastes dans l'existence même des institutions chargées d'encadrer la propriété industrielle. Tandis que l'Allemagne se dote à Berlin d'un Patentamt performant, la France peine à restructurer ses services de propriété industrielle malgré la création de l'ONPI en 1901. À la veille de la première Guerre Mondiale des acteurs français de la propriété industrielle tentent de s'inspirer du cadre allemand pour réformer la législation en France. Ces tentatives restent vaines tant l'héritage libéral porté par la loi de 1844 fait encore sentir son poids
