PERJANJIAN SEWA MENYEWA TANAH KAS DESA ANTARA PEMERINTAH KELURAHAN CONDONGCATUR DENGAN PEMERINTAH DAERAH KABUPATEN SLEMAN DI DAERAH ISTIMEWA YOGYAKARTA PERSPEKTIF HUKUM PERDATA (Studi Kasus Taman Kuliner Condongcatur)

This study aims to discuss and examine land management administered by a village council as a manifestation of the mandate of Article 2 section (4) of Law Number 5 of 1960 concerning the fundamentals of Agrarian Principles. Furthermore, this study analyzes mechanism and types of agreements used in leasing involving village treasury land, especially in Condongcatur. The lease agreements analyzed were made between Condongcatur Village Council, Sleman License Agency, Street Vendors and the Technical Implementation Unit (UPT) of Taman Kuliner Condongcatur.Thus, the purpose of the research is to find out how leasing mechanism of village treasury land works and about the types of agreements made. Normative and empirical method was implemented in this reseach by examining data directly in the field and gathering information from direct interviews with related parties. The results of this study are based on a descriptive data analysis applied to solve problems in the research. The results of the study show that the agreement between the owner of the village treasury land and the manager of Taman Kuliner was considered valid because it was made in written form even though several essential elements were not included. The agreement between the street vendors and the manager of Taman Kuliner was only made verbally so it was not clear what clauses were agreed upon. Obstacles found in practice include the length of the licensing process, changes in government managers which result in vague access policies and the types of agreements that are not made in a detailed and written form
