Les modes de scrutins locaux dans la réforme du territoire

11 pagesThis communication resorts to the voting systems (and their various reforms throughout Acts I and II of the French decentralization) to analyze the territory and its evolutions. The study so bases itself on the analysis of the parliamentary debates relative to the various laws relative to the local voting systems as well as on that of the texts of laws and the Constitution. A double report emerges from it. First of all, the legislator uses the reforms of the voting systems to dedicate certain territorial order, marked by the constant assertion of the administrative character of the local elections and by the implicit hierarchical organization of regions with a measure of autonomy in favor of the traditional communities (municipalities and departments). In spite of the assertions of the legislator, the implemented of the local voting systems is nevertheless translated by the expression of a real territorial power, the political character of which makes not many doubts (decision n° 82-146 DC). The voting systems seem to allow an expression rationalized to the territorial power; the politicization, far from having the devastating effects of which was afraid the legislator, does not thus prevent the efficiency of the public action (underlying requirement in the instrumental conception carried by the legislator).Cette communication recourt aux modes de scrutins (et leurs différentes réformes tout au long des Actes I et II de la décentralisation française) pour analyser le territoire et ses évolutions. L'étude se fonde ainsi sur l'analyse des débats parlementaires relatifs aux différentes lois relatives aux modes de scrutin locaux ainsi que sur celle des textes de lois et de la Constitution. Il en ressort un double constat. Tout d'abord, le législateur utilise les réformes des modes de scrutin pour consacrer un certain ordre territorial, marqué par l'affirmation constante du caractère administratif des élections locales et par une hiérarchisation implicite des collectivités territoriales en faveur des collectivités traditionnelles (communes et départements). Malgré les affirmations du législateur, la mise en œuvre des modes de scrutins locaux se traduit pourtant par l'expression d'un véritable pouvoir territorial, dont le caractère politique ne fait guère de doutes (déc. n° 82-146 DC). Les modes de scrutin semblent ainsi permettre une expression rationalisée du pouvoir territorial ; la politisation, loin d'avoir les effets dévastateurs que craignait le législateur, n'empêche donc pas l'efficacité de l'action publique (exigence sous-jacente à la conception instrumentale portée par le législateur)
