TANGGUNGJAWAB HUKUM PERUSAHAAN TAMBANG DALAM PENGENDALIAN KERUSAKAN LINGKUNGAN HIDUP DI KALIMANTAN TENGAH (Studi Kasus Di PT. Asmin Bara Bronang)

One of the abundant natural resources in the province of Central Kalimantan is coal. The activity of the coal mining sector in fact causes a variety of environmental damage. This thesis is concerning the liability of mining companies in controlling environmental damage due to mining activities. The formulation of the problem of this thesis is how Legal Liability in Control of Enviromental Damage in Central Kalimantan (Case Study at PT Asmin Bara Bronang, Central Kalimantan). This legal writing is an empirical legal research. Based on this research to the conclusion the form of liability undertaken by PT. Asmin Bara Bonang on controlling environmental damage in the mining area of Central Kalimantan has been running as it should but not yet optimal. Some environmental damage resulting from mining activities can still be overcome by the existence of a set pond around the stock pile, but other conditions of environmental damage cannot be overcome due to several obstacles such as the existence of regulations from the government that prioritize it (in terms of environmental damage risk turbid water on dredged land) are also some other obstacles that cannot be avoided such as environmental damage due to changes in the shape of the landscape, as well as other obstacles such as human resources that are not yet fully capable, especially for the majority of new company employees, to the constraints of rampant illegal mining or mining without permits outside the company activities that are actually rife by the surrounding community
