PERLINDUNGAN HUKUM BAGI PENGGUNA LAYANAN KESEHATAN PADA MASA DARURAT KESEHATAN COVID-19 BERDASARKAN UNDANG -UNDANG NOMOR 36 TAHUN 2009 TENTANG KESEHATAN ( STUDI DI RSUD KABUPATEN JOMBANG )

The existence of a covid-19 health emergency in Indonesia certainly requires a design in the flow of health services. One of the problems about mothers who will give birth in one of the hospitals during the pandemic that does not immediately get a crackdown due to swab test results declared reactive, resulting in the loss of life of babies born without the help of health workers. Adjustments to pandemic situations require a change in standards in the health service. The changes are important things that must be protected, namely related to the rights of patients contained in Law No.36 of 2009 on Health and Law No.44 of 2009 on Hospitals. The problems in this study related to how the fulfillment of standards in health services during the covid-19 health emergency and legal protection of the rights of health service users during the covid-19 pandemic in Jombang District Hospital. The purpose of this study is to know the implementation of health care standards that exist in the current health emergency and a form of legal protection to health care users if any of their rights are not met or even cause harm to themselves during the health care during the covid-19 health emergency. The method used in this study is empirical sociology method which is a study at Jombang District Hospital. The results of the study provide clarity that in adjusting health care standards in times of health emergency there are still some that can not be implemented to the maximum because of the lack of education to the community. And for the form of legal protection at the research site can be said in accordance with providing protection to the rights owned by patients by applying two ways can direct with deliberation or provide compensation according to the losses obtained
