STATUS KEWARGANEGARAAN EKS KELUARGA ISIS DITINJAU DARI HAK DAN KEWAJIBAN SEBAGAI WARGA NEGARA INDONESIA

Judging by the large number of indonesians who joined the terrorist organization on behalf of the group, namely the Islamic State of Iraq and Syria (ISIS) minister of law and human rights Yasona Laoly said that about 1,276 indonesian citizens who joined 297 validated have passports and some do not have passports. of course this becomes a logical consequence for the indonesian people who belong to the terrorist group considering the rules in Indonesia that strictly prohibit even revoke the citizenship of the person if proven to belong to the terrorist group,considering the movement of the group is oppression and violence against everyone of course this makes it a target and a common enemy of various countries in the world. By joining these countries to relent this terrorist organization over time began to suffer defeat and many members of this terrorist group were arrested while in their camps, of course this has a huge impact on families who are left behind and experiencing bad conditions such as shortages of food, poor health conditions and poor environment.Many of them want to return to their home countries, one of which is from indonesian citizens who want to return to the country, but the issue of their return is tinged with controversy and rejection from both the community and the government. So with the controversy, the author raised the issue related to citizenship status and its rights and obligations as an Indonesian citizen as for the method used by the author in this study is Normative Juridical with the technique of collecting literature studies. In this case, the ex-isis family still has citizenship status because of the incontinent element of article 23 of Law No. 23 of 2006 on Citizenship and the unfulfillment of elements of the formation of the state, but with the government statement that refuses their return then in this case they automatically lose their citizenship status and rights and obligations, but in this case there are exceptions related to children who are not yet legally capable for cells followed up by the government to return to the country
