PENEGAKAN HUKUM PIDANA TERHADAP PELAKU PENJUALAN KOSMETIK TANPA IZIN EDAR BPOM (Studi kasus di Kepolisian Daerah Jawa Timur dan BBPOM Jawa Timur di Surabaya)

The era of modernization, people's consumptive behavior is increasing faster so that the demand for consumption of goods and services increases. As with beauty products that are in demand, namely cosmetics, currently there are many illegal cosmetic products circulating which are a great opportunity for sellers to sell cosmetic products that ineligible for quality, quality and safety requirements. Therefore, consumers experience material losses and immaterial losses that make the health of the people who use them potentially in danger. The authors formulate 3 (three) problems, namely: How is the enforcement of criminal law against perpetrators of selling cosmetics without a distribution permit by the East Java Regional Police and BBPOM Surabaya, What are the obstacles experienced by the East Java Regional Police and BBPOM Surabaya in an effort to overcome the sale of cosmetics without a permit. The approach method used in this research is sociological juridical using qualitative analysis as data analysis. The factors in law enforcement against cosmetic sellers without a distribution permit are legal factors, law enforcement, facilities and facilities, society, and culture. The role of law enforcement in tackling this problem in a preventive and repressive manner is owned by each agency. Constraints experienced in law enforcement starting from internal and external factors. Conclusions and suggestions are the need to increase supervision and firmness between the cooperation of the two agencies towards sellers in order to break the chain of selling cosmetics without distribution license
