URGENSI PENAMBAHAN KEWENANGAN MAHKAMAH KONSTITUSI REPUBLIK INDONESIA DALAM MENGUJI CONSTITUTIONAL COMPLAINT SEBAGAI BENTUK PERLINDUNGAN HAK KONSTITUSIONAL WARGA NEGARA

Violation of the constitutional rights of citizens by state institutions or public officials should be a serious concern to be resolved by the Constitutional Court of The Republic of Indonesia. But until now the Constitutional Court of The Republic of Indonesia has not had the authority to resolve the issue. So it is very important to expand the authority of the Constitutional Court of Indonesia to conduct a constitutional complaint to ensure the protection of constitutional rights of citizens to the maximum. This paper aims to know and analyze the urgency and ideal concept of constitutional complaint by the Constitutional Court of Indonesia in the future. Penelitian in this paper uses normative juridical research method by using conceptual approach method (conseptual approach) and comparative approach (comparative approach) as well as the technique of collecting literature study materials. The results of this study show that, First there is an urgency to expand the authority of the Constitutional Court of Indonesia in mengadili constitutional complaint case to fill the legal vacancy by looking at various concrete cases such as amhadiyah dissolution cases, badrul kamal cases, and pollycarpus cases. Both expansion of constitutional complaint authority is done by amending article 24C paragraph (1) of the 1945 NRI Constitution and there is an altenative if it has not been made amendments to the 1945 NRI Constitution, namely by legislative interpretation or judicial interpretation. There are conclusions and suggestions from the author namely the urgency to expand the authority of the Constitutional Court of The Republic of Indonesia can not be delayed anymore and must be applied immediately and penerapkan constitutional complaint in Indonesia can be done by amendingarticle 24C paragraph (1) NRI Constitution 1945, revision of the Law on constitutional court and issuing a Regulation of the Constitutional Court to regulate the constitutional complain
