IMPLEMENTASI PENEGAKAN HUKUM TERHADAP TINDAK PIDANA PENAMBANGAN EMAS TANPA IZIN BERDASARKAN UNDANG-UNDANG NOMOR 3 TAHUN 2020 TENTANG PERTAMBANGAN MINERAL DAN BATUBARA DI WILAYAH HUKUM KEPOLISIAN RESORT SIJUNJUNG PROVINSI SUMATERA BARAT

Illegal gold mining practices are increasingly prevalent in Sijunjung Regency, resulting in various damages to facilities and infrastructure and the environment. The seriousness of this mining practice is considered an ordinary violation because it has been going on for generations. Referring to article 158 of the Minerba Law, it has regulated concretely regarding the criminal sanction of gold mining without this permit, so this research basically looks at how the implementation of law enforcement against the criminal act of gold mining without a license by the Sijunjung Resort Police according to the Minerba Law and what the Sijunjung Police are trying to do tackling unlicensed gold mining. The results of the analysis in this study are first, law enforcement uses article 158 of the Minerba Law when there are reports from the public and raid activities carried out with the West Sumatra Police. Internal constraints, namely the dilemma of the police in following up on cases due to the economic factors of the community and the lack of personnel who are experts in handling mining cases. External constraints are the lack of coordination with the Mining and EMR Service, a lack of public understanding of criminal sanctions for gold mining without a permit and community resistance when arrests are made. Second, the police's efforts to overcome them by taking preventive measures in the form of socialization when searching for locations and posting posters about gold mining crimes without a license and sanctions in front of the Sijunjung Police Office. Repressive measures, namely following up cases through criminal channels. This study recommends that the police should act decisively, carry out intensive coordination with the Mining and EMR Service and mining personnel who are experts in handling mining cases. As a countermeasure, the police should schedule routine outreach activities in areas with potential and many gold mining activities without a license
