El recurso de casación civil en relación con el principio de seguridad jurídica en Ecuador

The investigation sets out to analyze the incidence of the setting of the surety when granting the appeal in precautionary matters; basically the constitutional principle of legal security, and to generate confidence in the administration of justice. From the quantitative paradigm, it is an investigation with a documentary descriptive methodology with a bibliographic design, recognizing the documentary search in bibliographic and legal sources, previous research, laws and regulations. A questionnaire was applied to 15 lawyers in free practice of the City of Portoviejo. It is concluded that although it is true that the lawyers have a basic knowledge of the extraordinary remedies of the Ecuadorian legal system, very few of them have filed an appeal for cassation, this mainly due to the fact that they are neither qualified nor trained to carry out this appeal.La investigación se plantea analizar la incidencia de la fijación de la caución al conceder el recurso de casación en materia precautelar; básicamente el principio constitucional de seguridad jurídica, y generar confianza de la administración de justicia. Desde el paradigma cuantitativo, es una investigación con una metodología de tipo descriptiva documental con un diseño bibliográfico, reconociendo la búsqueda documental en fuentes bibliográficas, jurídicas, investigaciones previas, leyes y normas. Se aplicó un cuestionario a 15 abogados en libre ejercicio de la Ciudad de Portoviejo. Se concluye, que si bien es cierto los abogados tienen un conocimiento básico de los recursos extraordinarios del ordenamiento jurídico ecuatoriano, muy pocos de ellos han interpuesto un recurso de casación, esto debido principalmente a que no están capacitados y ni formados para realizar este recurso
