TINJAUAN YURIDIS HAK ASUH ANAK DIBAWAH UMUR DALAM PERKARA NOMOR 5657/Pdt.G/2020 DI PENGADILAN AGAMA KABUPATEN MALANG

ABSTRACTResearch on the legal consequences of divorce, namely child custody, the application of case studies in the Religious Courts of Kab.Malang Number 5657/Pdt.G/2020. The formulation of the research problem is: 1.Determination of Child Custody according to the Marriage Law and the Compilation of Islamic Law.2.Legal considerations on child custody in case number 5657/Pdt.G/2020. The research method uses normative legal research. Discussion on the Determination of Custody of Minors in the Marriage Law No.1 of 1974 has been amended by Law No. 16 of 2019 concerning Law No. 1 of 1974 concerning Marriage in Article 41 of Law Number 1 of 1974. Custody of Minors in Compilation Islamic Law Articles 105 and 106. Legal considerations in the Religious Court Decision Number 5657/Pdt.G/2020 related to child custody giving control and maintenance of children to their mothers because the child is still 1 year old and not yet mummaayiz(age less than 12 years).Key words: Child Custody, Underage, Religious Court.ABSTRAK Penelitian dari akibat hukum perceraian yaitu hak asuh anak penerapan studi kasus di Pengadilan Agama Kab. Malang Nomor 5657/Pdt.G/2020. Rumusan masalah penelitian yaitu:1.Penetapan Hak Asuh Anak menurut Undang-Undang Perkawinan dan Kompilasi Hukum Islam.2.Pertimbangan hukum terhadap hak asuh anak dalam perkara nomor 5657/Pdt.G/2020. Metode penelitian mengunakan penelitian hukum normatif. Pembahasan Penetapan Hak Asuh Anak dibawah umur dalam Undang-Undang Perkawinan No.1 Tahun 1974 telah dirubah dengan UU Nomor 16 Tahun 2019 Tentang UU Nomor 1 Tahun 1974 Tentang Perkawina pada Pasal 41 UU No.1 Tahun 1974. Hak Asuh Anak dibawah umur dalam Kompilasi Hukum Islam Pasal 105 dan 106. Pertimbangan hukum pada Putusan Pengadilan Agama Nomor Perkara 5657/Pdt.G/2020 terkait hak asuh anak memberikan penguasaan dan pemeliharaan anak kepada ibunya karena anak masih usia 1 tahun belum mummaayiz(usia kurang dari 12th)
