TANGGUNGJAWAB PROFESI DOKTER YANG MELAKUKAN MALPRAKTIK MEDIS MENURUT HUKUM PIDANA JUNCTO PASAL 58 UNDANG-UNDANG NOMOR 36 TAHUN 2009 TENTANG KESEHATAN

ABSTRACK This research departs from the problem of malpractice by the medical profession in the medical field. There are two formulations of internal problems. This research is: 1. Whats is the responsibility of this doctor who commits medical malpractice according to the criminal law in conjuction with law no. 36 of 2009. 2. Can the victim the accountability under Article 1365 of the Civil Code for the act of a doctor who committed malpractice? The research method in this research method in this research is normative juridical/ The sources of law used in this paper are primary secondary and tertiary sorces of law. The research approach uses a conceptual approach, laws and regulations, and case studies.The conclusion of this study the criminal responsibility of doctors for errors and negligence in providing medical services, ehere the responsibility of doctors in criminal law can ve categorized as criminal malpractice if it fulfills the formulation of criminal affenses, namelu that the act must be a disgraceful act must be a disgraceful act and an inner attide is carried out, wrong, namelyin the from of intent carelessness, and mistakes. Responsibility based on the civil code for the actions of doctors who commit malpractice where the patient can sue for the legal responsibility of medicine in the event that they commit errors/negligence.Keyword: Responsibility, Malpractice, doctorsABSTRAK Penelitian ini berangkat dari permasalahan malapraktik profesi dokter dalam bidang medis. Terdapat dua rumusan masalah dalam penelitian ini yaitu. 1.Bagaimana tanggungjawab profesi Dokter yang melakukan malpraktek medis menurut Hukum Pidana juncto Undang-Undang Nomor 36 Tahun 2009 ? 2. Apakah korban dapat mengajukan tanggung gugat berdasarkan pasal 1365 KUHPerdata atas tindakan Dokter yang melakukan Malpraktek ? Metode penulisan pada penelitian ini adalah yuridis normatif Sumber hukum yang digunakan pada penulisan ini yaitusumber hukum primer, sekunder, tersier. Pendekatan penelitian melalui pendekatan konseptual (conceptual approach), pendekatan perundang-undangan (statute approach). Kemudian teknis analisis bahan hukum menggunakan deskriptif kualitatif. Kesimpulan dari penelitian ini yaitu pertanggungjawaban pidana terhadap dokter atas kesalahan dan kelalaian dalam memberikan pelayanan medis, dimana tanggungjawab dokter dalam bidang hukum pidana suatu perbuatan dapat dikategorikan sebagai criminal malpractice apabila memenuhi rumusan delik pidana yaitu merupakan perbuatan tersebut harus merupakan perbuatan tercela dan dilakukan sikap batin yang salah yaitu berupa kesengajaan, kecerobohan atau kelapaan. Tanggunggugat berdasarkan pasal 1365 KUHPerdata atas tindakan Dokter yang melakukan Malpraktek, dimana pasien dapat menggugat tanggungjawab hukum kedokteran (medical liability), dalam hal dokter tersebut berbuat kesalahan/kelalaian.
