Tanggung Jawab Hukum Produsen Otomotif Terhadap Cacat Produk (Product Liability) Menurut Undang-Undang Nomor 8 Tahun 1999 Tentang Perlindungan Konsumen : indonesia

This study aims to determine the form of producer legal responsibility for product defects according to the Consumer Protection Act, and to find out how to resolve consumer disputes against product defects according to the Consumer Protection Act. The type of research used is normative juridical research using statutory approaches, conceptual approaches and case approaches. From the research it can be concluded that the producer is responsible for the goods purchased from the producer. The application of the principle of absolute responsibility is intended to replace the system of responsibility based on Article 1365 of the Civil Code and the system of proof in Article 1865 of the Civil Code for cases of consumer losses due to using defective products. Settlement of consumer disputes either through the District Court or alternative dispute resolution conducted through the Consumer Dispute Resolution Agency according to Law No.8 of 1999 concerning Consumer Protection, there are 3 (three) types of dispute resolution through BPSK, namely by mediation, arbitration and conciliation . If the consumer is harmed in consuming goods or services, he can sue the party causing the loss. Parties here mean producers / factories, suppliers, wholesalers, retailers / sellers or parties who market products, depending on who does or does not commit acts that cause harm to consumers. Abstrak Penelitian ini bertujuan untuk mengetahui bentuk tanggung jawab hukum produsen terhadap cacat produk menurut Undang-Undang Perlindungan Konsumen, serta untuk mengetahui bagaimana penyelesaian sengketa konsumen terhadap cacat produk menurut UU Perlindungan Konsumen. Tipe penelitian yang digunakan adalah penelitian yuridis normatif dengan menggunakan pendekatan peraturan perundang-undangan, pendekatan konseptual dan pendekatan kasus. Dari penelitian dapat disimpulkan bahwa, produsen bertanggung jawab terhadap barang-barang yang dibeli dari produsen. Penerapan prinsip tanggung jawab mutlak dimaksudkan untuk mengganti sistem tanggung jawab berdasarkan Pasal 1365 KUHPerdata dan sistem pembuktian dalam Pasal 1865 KUHPerdata untuk kasus-kasus kerugian konsumen akibat menggunakan produk yang cacat. Penyelesaian sengketa konsumen baik melalui Pengadilan Negeri atau alternatif penyelesaian sengketa yang dilakukan melalui Badan Penyelesaian Sengketa Konsumen menurut Undang-Undang No.8 Tahun 1999 mengenai Perlindungan Konsumen, terdapat 3 (tiga) macam cara penyelesaian sengketa melalui BPSK yaitu dengan cara mediasi, arbitrase dan konsiliasi. Apabila konsumen dirugikan di dalam mengkonsumsi barang atau jasa dapat menggugat pihak yang menimbulkan kerugian. Pihak di sini berarti produsen/pabrik, supplier, pedagang besar, pedagang eceran/penjual ataupun pihak yang memasarkan produk, tergantung dari siapa yang melakukan atau tidak melakukan perbuatan yang menimbulkan kerugian bagi konsumen
