The impact of Chinese arbitration law and services on international arbitration law and practice

Arbitration is one of the most important alternative dispute resolutions in the world. China has a relatively short history of modern arbitration, but its developments have been great. The interest in Chinese arbitration has been escalating in both eastern and western countries, especially in relation to the Belt and Road Initiatives and the Asian Infrastructure Investment Bank. This thesis intends to provide in-depth analysis and evaluations on the law and practice of Chinese commercial arbitration. The advantages and disadvantages of Chinese commercial arbitration are explored in this thesis and it attempts to clarify some concerns over Chinese arbitration in foreign countries. The focus is also on the real issues of Chinese arbitration law and practice and provides suggestions to the reform of Chinese arbitration law. Another important goal of this thesis is to examine and analyse the most recent developments of Chinese commercial arbitration in the Belt and Road Initiative, the Asian Infrastructure Investment Bank and Free Trade Zones. These developments are considered to be vital to the future of Chinese arbitration and they may pave the way for China to become one of the international arbitration centres. Some other Chinese experiences in arbitration such as mediation-arbitration, online arbitration and domain name arbitration are also discussed in this thesis. These Chinese experiences may be proven valuable in the development of international arbitration. From the above aspects, the impact of Chinese arbitration law and practice on international arbitration law and practice is discussed in this thesis
