O tratamento jurídico da pornografia de vingança no Brasil

Due to the development of new technologies, the tools for capturing, disseminating and storing images have multiplied. Thus, the personality rights, especially image and privacy, become more vulnerable on the network. Cases of intimate image disclosure on the Internet are increasingly common, which can cause great harm to the dignity of the person portrayed. The subject of revenge porn fits into this context. This practice occurs when intimate images (with nudity or sexual act) that have been recorded or sent in a context of trust and confidentiality are disclosed without the victim's consent. Given the above, the present article intends, from a civil-constitutional reading, to verify how the Brazilian Courts treat the subject, and analyze the mechanisms of protection of these rights, using the Brazilian Civil Rights Framework for the Internet and/or the criminal classification of conduct and how the internet provider is responsibilized. Finally, it is concluded that the injury to the right to image independent of injury to the honor. In this way, the unjustified or unauthorized use of the image is enough to give the victim the right to receive compensation for the moral damage suffered.A partir do desenvolvimento de novas tecnologias, os instrumentos de captação, divulgação e armazenamento de imagens se multiplicaram. Dessa forma, os direitos da personalidade, especialmente a imagem e a privacidade, tornam-se mais vulneráveis na rede. São cada vez mais comuns os casos de divulgação de imagens íntimas na Internet, o que pode causar grandes danos à dignidade da pessoa retratada. Nessa seara, insere-se a temática da pornografia de vingança. O termo é utilizado quando são divulgadas, sem o consentimento da vítima, imagens íntimas (com nudez ou prática de ato sexual) que foram registradas ou enviadas em um contexto de confiança e sigilo. Diante do exposto, o presente artigo pretende, a partir de uma leitura civil-constitucional, verificar como os Tribunais brasileiros vêm tratando do tema e analisar os mecanismos de tutela desse bem jurídico, através do Marco Civil da Internet e/ou da tipificação penal da conduta e como se dá a responsabilização do provedor de internet. Conclui-se, ainda, que a lesão ao direito à imagem independe de lesão à honra. Dessa maneira, basta o uso injustificado da imagem para que surja, para a vítima, o direito de receber uma compensação pelo dano moral sofrido
