Medidas socioeducativas em meio fechado: punir e ressocializar?

This work addresses the issue of socio-educational measures in a closed environment, punishment and re-socialization. For a more complete and comprehensive approach to the topic, a brief historical reconstruction of the trajectory related to the rights of children and adolescents is brought to the debate. It also focuses on the legal apparatus that permeates the youth population, both internationally and nationally, as well as socio-educational measures in kind, the dichotomy between the social function of punishment and resocialization and the influence of negative measures in a closed environment. The study is based on literature review, scientific articles, in addition to data analysis, documents and legislation on the subject. Finally, it is concluded that, due to the peculiar nature of socio-educational measures, they must be analyzed in order to seek the re- socialization of young offenders, in compliance with the Principle of Integral Protection. However, although Brazil has excellent legislation aimed at the full protection and promotion of children and adolescents, what is contained in the legislation ends up not being implemented, without tangible practical results, in order to effectively implement the constitutional and legal presupposition regarding material rights of children and adolescents. There is a lack of adequate and necessary conditions in closed establishments, which ends up harming both the development and the social and family reintegration and reintegration of young people.O presente trabalho contempla o tema acerca das medidas socioeducativas em meio fechado, a punição e a ressocialização. Para uma abordagem mais completa e abrangente do assunto, são trazidas ao debate uma breve reconstrução histórica da trilha relacionado aos direitos das crianças e adolescentes. Debruça-se, ainda, sobre o aparato jurídico a qual permeia a população infantojuvenil, tanto no âmbito internacional quanto no cenário nacional, bem como apresenta-se as medidas socioeducativas em espécies, a dicotomia entre a função social de punição e ressocialização e a influência negativa das medidas em meio fechado. O estudo se baseia através de revisão bibliográfica, artigos científicos, além de análise de dados, documentos e legislação sobre o referido tema. Por fim, conclui-se que pela natureza peculiar das medidas socioeducativas, as mesmas devem ser analisadas de forma na qual buscam a ressocialização do jovem que tenha praticado ato infracional, levando-se em conta o princípio da Proteção Integral. Todavia, apesar de o Brasil possuir excelentes leis que visam a proteção e promoção integral das crianças e adolescentes, tem-se que o que é contido na legislação acaba por não se concretizarem, sem resultados práticos palpáveis, no sentido de se tornar realmente realidade a premissa constitucional e legal referente ao direito material da criança e do adolescente. Há falta de condições adequadas e necessárias nos estabelecimentos em meio fechado, que acabam por prejudicar tanto a reeducação e ressocialização do adolescente quanto sua integração social
