IMPLEMENTASI SOCIAL JUSTICE DALAM PENEGAKAN HUKUM BIDANG PERIKANAN DAN KELAUTAN DI INDONESIA

The State of Indonesia is a country with a wide territorial waters which of course requires management procedures so that the results obtained from these waters can be enjoyed for welfare and justice for all Indonesian people. The authority of fisheries and marine management in Indonesia has been delegated to the regional government through regional autonomy. In Law no. 32 of 2004, regional governments can exercise the widest possible autonomy, except in matters that are under the authority of the Central Government. Law no. 23 of 2014, has given authority to the Regional Government in the broadest possible autonomy in an effort to improve the welfare of the people in its territory without any further restrictions. The authority of the regional government in autonomy has undergone changes, but these changes are not in line with the principles of social justice (as stated in Article 33 of the 1945 Constitution), where the management of fisheries and marine wealth is only oriented to their respective regions so that the application of social justice in obtaining Indonesian waters. for all Indonesian people becomes invisible.Keywords: Social, Justice, Fisheries, Marine
