ANALISIS PUTUSAN BADAN PENYELESAIAN SENGKETA KONSUMEN (BPSK) YANG TELAH DIBATALKAN MAHKAMAH AGUNG RI (Analisis Putusan Nomor : 1212/Pdt.Sus-BPSK/2020/PN Sby.)

Consumers are every person who uses goods available in the community, either for their own benefit, their family or others, and not for trading. Whereas consumer protection is a legal rule that is applied to protect and implement rights for consumers, disputes are situations and conditions where people experience factual disputes or disputes according to their perceptions only, Consumer Disputes are disputes between business actors and consumers who demand compensation. loss for damage, pollution, and/or suffer losses due to consuming goods and/or utilizing services produced or traded, BPSK is the agency in charge of handling and resolving Consumer Disputes. This study uses the theory of legal certainty, the theory of legal interpretation, the theory of legal justice, and the theory of legal expediency. The purpose of this study was to determine the authority of the Surabaya City BPSK in deciding case no. 25/BPSK/XI/2020, and knowing the judge's considerations in deciding case No. 1212/Pdt.Sus-BPSK/2020/PN Sby with a justice and expediency approach. This study uses descriptive analysis using a normative juridical approach that uses library data as a data source. BPSK Surabaya City should not have the authority to decide case No. 25/BPSK/XI/2020 because the object of the dispute is outside the authority of BPSK. Decision No. 1212/Pdt.Sus-BPSK/2020/PN Sby contains injustice and lacks benefit, due to lack of attention to evidence in court, and applicable laws and regulations, as well as the impacts of these decisions.Keywords: consumer protection, service protection, BPSK
