TITULARIZACIÓN EN LA REPÚBLICA DE PANAMÁ: INSTRUMENTO JURÍDICO FINANCIERO DE APOYO PARA LA EXPANSIÓN COMERCIAL

The present contribution of dogmatic documentary research, has as general objective to enter in the nature of the securitization as a legal financial strategy that contributes in the fortification of the mercantile persons, to achieve its expansion in the local and international markets. Said presentation is made exposing or confronting the work carried out by the foreign legislator with the specific objectives of the points that refer to the securitization in the law of the Republic of Panama, such as the following: Resolution No. 880 of January 12, 1995, Sole Text of the Securities Law, Law 1 of July 8, 1999, and Agreement 3- 2017, of April 5, 2017, as well as being able to demonstrate the behavior of the national capital market by virtue of the use of this tool in its modality called securitization by sector.El presente aporte de investigación dogmática documental, tiene como objetivo general adentrarse en la naturaleza de la titularización como una estrategia jurídico financiera que coadyuva en el fortalecimiento de las personas mercantiles, para lograr su expansión en los mercados locales e internacionales. Dicha presentación se hace exponiendo o confrontando el trabajo efectuado por el legislador foráneo con los objetivos específicos de los puntos que aluden a la titularización en la ley de la República de Panamá, como las siguientes: la resolución Nº 880  del 12 de enero de 1995, Texto Único de  la Ley de Valores,  Ley 1 del 8 de julio de 1999, y Acuerdo 3- 2017,  del 5 de abril de 2017, así como también poder evidenciar el comportamiento del mercado  de capitales nacional en virtud de la utilización de esta herramienta en su modalidad denominada titularización por sector
