La autoría mediata en la dogmática penal alemana

This paper explains how Principal by Proxy has been understood in German criminal theory. For this, the bibliographic review technique of different German authors regarding the subject was used. Free translations of German theoretical and normative texts were also carried out. One of the most relevant points of discussion was that of the control of the will can occur through a control of the will by virtue of coercion, a control of the will by virtue of error, and a control of the will by virtue of government organized of power. In it, it was concluded, among others, that there is Principal by Proxy in the domain of the will by virtue of error when the subject who acts as a means in the fact does so without intent; or acts with error of prohibition; or when the executor mistakenly assumes circumstances that release him from all responsibility; or when the subject behind sees or understands the magnitude better.  El presente artículo explicó cómo se ha entendido la autoría mediata en la dogmática penal alemana. Para esto, se utilizó la técnica de revisión bibliográfica de distintos autores alemanes respecto a la temática. También se realizaron traducciones libres de textos teóricos y normativos alemanes. Uno de los puntos de discusión más relevantes fue el relativo a que el dominio de la voluntad puede darse mediante un dominio de la voluntad en virtud de coacción, un dominio de la voluntad en virtud de error y un dominio de la voluntad en virtud de aparatos organizados de poder. En el mismo se llegó a la conclusión, entre otras, que hay autoría mediata en el dominio de la voluntad en virtud de error cuando el sujeto que actúa como medio en el hecho lo hace sin dolo; o se encuentra en un error de prohibición; o cuando el ejecutor supone erradamente circunstancias que lo liberan de toda responsabilidad; o cuando el sujeto de atrás ve o comprende la magnitud mejor
