Isbat Nikah Sirri di Pengadilan Agama Pasir Pengaraian Menurut Undang-undang Nomor 1 Tahun 1974 Tentang Perkawinan dan Kompilasi Hukum Islam

Isbat Nikah Sirri is a process of determining marriages conducted in the Religious Courts by two married couple, where previously a marriage had been conducted but was not recorded in th Office of Religious Affairs (KUA). The purposeof isbat nikah sirri is to abtain a marriage certificate so that the sirri marriage has the proof and certainty and strength of the law. This Study revealed a problem, that is: (1) How the implementation of Isbat Nikah Sirri in the Religious Court Pasir Pengaraian, (2) Why was the Isbat Nikah Sirri in the Religious Court Pasir Pengaraian widely granted, (3) How the Judge views the Isbat Nikah Sirri in the Religious Court Pasir Pengaraian. This research is an observational legal research (observational research) that is by conducting a survey directly to the research location. In this case the author tries to see first hand the implementation of Isbat Marriage Marriage in the Pengaraian Sand Religious Court, paying attention to the factors that were granted by Isbat Nikah Sirri and understanding the views and grounds of the Judge in deciding it. The data collection method used is the interview method and questionnaire. As for the method of data analysis, the writer uses descriptive qualitative method, which is analyzing the data that has been obtained and then explained, described, and described according to the problem. The results of the study concluded that the marriage certificate in the Religious Court of the Pasir Pengaraian was granted because nikah sirri carried out by the parties who submitted the application for the marriage certificate were carried out in accordance with the rules of Islamic law. Then the parties who carry out nikah sirri are also not bound to marriage with other people, and the benefit arising from being granted an application for Isbat Nikah Sirri is greater than the Isbat Nikah Sirri is rejected, not accepted (NO), revoked or aborted
