The paper addresses the issue of the current ability of art. 28 Workers’ Statute to safeguard the constitutional rights involved in industrial relations. The analysis starts from three decisions of the Court of Florence, Milan and Bologna concerning digital platforms’ conducts that the Trade Unions considered harmful to the freedom of association and to collective bargaining.
