Las leyes básicas y el mito de la revolución constitucional en Israel

The promulgation of the Basic Laws in 1992, marked a change in the constitutional system, called "Constitutional Revolution." However, no constitutional supremacy and no one can say that is a constitution in the formal sense. The Basic Laws can be changed by the Knesset (Israeli Parliament) where necessary in the public interest. The Israeli Supreme Court has played an important role in protecting human rights through judicial review of legislation contrary to the Basic Laws. This article try to demonstrate that these standards are an important development in the Israeli legal system, protection of civil rights, generating an evolution not a revolution over the Constitution. It is therefore necessary to consider the creation of a constitution that protects basic rights without exception.La promulgación de las Leyes Básicas en 1992, supuso un cambio en el sistema constitucional de Israel que se denominó “Revolución Constitucional”. Sin embargo, no tienen supremacía constitucional y no se puede decir que representan una constitución en el sentido formal. Las Leyes Básicas pueden ser modificadas por el Knesset (Parlamento Israelí) cuando sea necesario por el interés general. El Tribunal Supremo de Israel ha jugado un papel importante en la protección de los derechos humanos- a través de la revisión judicial de las normas contrarias a las Leyes Básicas. Este artículo pretende demostrar que estas normas suponen un importante desarrollo en el sistema jurídico israelí en la protección de los derechos civiles, generando una evolución más no una revolución constitucional. Por consiguiente, es necesario tener en cuenta la creación de una Constitución nacional que proteja los derechos fundamentales de la población sin hacer ninguna excepción
