The question of human rights before and after Étienne Balibar : investigation into the equivocity of a concept

Cette thèse porte sur la question des droits de l’homme dans la philosophie de Étienne Balibar. Elle en fait une enquête qui retrace les équivocités contenues dans ce concept au moyen des repères posés par la philosophie politique de Balibar entre 1989 et 2009. Repères qui eux portent pour l’essentiel sur l’énonciation et l’institution des droits fondamentaux au cours d’un processus des luttes d’émancipation de la modernité, toutefois l’aspect créatif reste de ramener ces repères à une historicisation des sources premières donc depuis l’idée, la conceptualisation et les manifestations modernes et contemporaines des droits de l’homme. Dans cette perspective, il faut penser philosophiquement l’importance de la crise d’abord sous-jacente des droits de l’homme puis l’implication démocratique actuelle dont elle est l’objet. Une crise moderne qui se manifestait avec les deux guerres mondiales et qui pourtant paraissait s’ouvrir sur une nouvelle phase de refondation qui elle-même n’est pas exempte de nouvelles contradictions.This thesis deals with the question of human rights in the philosophy of Étienne Balibar. She makes an investigation which traces the equivocities contained in this concept by means of the benchmarks set by the political philosophy of Balibar between 1989 and 2009. Benchmarks which relate mainly to the enunciation and the institution of fundamental rights during of a process of struggles for the emancipation of modernity, however the creative aspect remains to bring these benchmarks to a historicization of the primary sources, therefore from the idea, conceptualization and modern and contemporary manifestations of human rights. From this perspective, we must think philosophically about the importance of the first underlying human rights crisis and then the current democratic implication of which it is the object. A modern crisis that manifested itself with the two world wars and yet seemed to open up a new phase of refoundation which itself is not free of new contradictions
