Civil protection of the pre-implantation human embryo: analysis on the adequacy and effectiveness of the legal system regarding assisted human reproduction techniques

O presente trabalho tem como objetivo analisar os efeitos que as novas descobertas científicas, relativas à individualidade e à autonomia biológica do embrião humano pré-implantatório, ensejam - ou deveriam ensejar - sobre o ordenamento jurídico vigente, realizando a necessária ponderação entre as referidas características e os destinos que se apresentam a tais embriões por ocasião do artigo 5º, inciso II, da Lei n. 11.105/2005 (Lei de Biossegurança) e pela Resolução CFM n. 2.168/2017, notadamente, sua doação para pesquisas e terapias com células-tronco embrionárias e o simples descarte, ambas a implicar em sua imediata destruição e, consequentemente, no encerramento de seu ciclo vital contínuo. Tais possibilidades, a partir disso, serão diretamente confrontadas pelo inafastável direito à vida, condicionante de todos os demais direitos de personalidade e, ainda, pelo princípio da dignidade da pessoa humana, titularizados pelo concepto humano desde a sua fecundação, ainda que extracorpórea, debruçando-se, ato contínuo, sobre diplomas internacionais e de direito estrangeiro no intuito de estabelecer-se um parâmetro razoável para a confecção de um estatuto apto a tutelar o embrião humano pré- implantatório, analisando-se os Projetos de Lei em trâmite perante o Congresso Nacional brasileiro e fazendo proposições entendidas como razoáveis a tal finalidade.The present study aims at analyzing the effects that new scientific discoveries, relating to the biological individuality and autonomy of the pre-implantation human embryo, demand - or should demand - under the current legal system in force, performing the needed analysis between the referred characteristics and the destinations presented to such embryos as per article 5, item II, of Law 11.105/2005 (Biosafety Law) and CFM Resolution 2.168/2017, in particular, their donation for research and embryonic stem cells therapy and simple discarding, in any case implying their immediate destruction and, consequently, the closure of their continuous life cycles. As a consequence such possibilities will be directly confronted by the undeniable right to life, condition to all other personal rights and also the principle of human dignity, granted to the human fetus from its fertilization, even if out of body, analysing immediately thereafter international laws and legal systems in order to set up a reasonable parameter for creating a statute able to protect the preimplantation human embryo, analyzing the pending law projects at the Brazilian Congress and making proposals that are considered reasonable for such purpose
