La transparencia como límite de la autonomía parlamentaria en las Asambleas Legislativas autonómicas

AbstractThe process of juridification of transparency as principle, rule and law in the public sector is object of reflection from a parliamentary perspective, arguing the transfer of its legal regime to the autonomous parliaments. The state of the issue is based on the principle of parliamentary autonomy as the main legal obstacle to the application of the principle of transparency, currently reduced to activities subject to administrative law in parliaments and shaped by the regulations and decisions of the organs Parliamentarians from the insitucionalhermeticism. The gap between the administration and parliament for transparency makes it possible to raise legal objections to divergencesbetween access to public and parliamentary information. The conflict between the principles of parliamentary autonomy and transparency emerges from areas of opacity without regulatory or conventional coverage and grounds the extrapolation of the limits of ordinary legislation to the information reserved by parliaments. Legal arguments are developed to extend the transparency of parliamentary acts in general, including the so-called internal corporate acts and to overcome the legal restriction on activities subject to administrative law. The recourse to the nature of transparency as an informing principle of the legal and public order and representative of the democratic principle (article 1.1 EC), its external dimension through the criterion of public interest and the vehicular condition of parliamentary information for the exercise of Fundamental rights, contributes to strengthening judicial review of parliamentary acts. The conclusions include the conversion of transparency into the limit of the principle of parliamentary autonomy, the tendency towards convergence between active and passive advertising, the progressive admission of a right of access to parliamentary information.Resumen:El proceso de juridificación de la transparencia como principio, norma y derecho en el sector público es objeto de reflexión desde una perspectiva parlamentaria, argumentando la traslación de su régimen legal a los parlamentos autonómicos. El estado de la cuestión se vertebra en torno el principio de autonomía parlamentaria como principal rémora jurídica para la aplicación del principio de transparencia, reducido en la actualidad a las actividades sujetas a derecho administrativo en los parlamentos y configurado por los Reglamentos y decisiones de los órganos parlamentarios desde el hermetismo institucional. La brecha entre la administración y el parlamento a efectos de transparencia permite plantear objeciones jurídicas a las divergencias entre el acceso a la información pública y parlamentaria. El conflicto entre los principios de autonomía parlamentaria y transparencia emerge de zonas de opacidad sin cobertura reglamentaria o convencional y fundamenta la extrapolación de los límites de la legislación ordinaria a la información reservada de los parlamentos. Se desarrollan argumentaciones jurídicas para extender la transparencia a los actos parlamentarios en general, incluidos los denominado acta interna corporis y superar la restricción legal a las actividades sujetas a derecho administrativo. El recurso a la naturaleza de la transparencia como principio informador del ordenamiento jurídico-público y representativo del principio democrático (art. 1.1. CE), su dimensión externa a través del criterio de interés público y la condición vehicular de la información parlamentaria para el ejercicio de derechos fundamentales, contribuye a reforzar el control jurisdiccional de los actos parlamentarios.
