DEMOCRACIA E DIREITOS HUMANOS: AS FUNÇÕES DO ESTADO E SUAS RELAÇÕES COM O INDÍVIDUO EM ESPAÇOS AMPLIADOS DE PARTICIPAÇÃO NACIONAL, INTERNACIONAL E TRANSNACIONAL

This paper aims to clarify the complexity of a relationship already widespread among human rights and democracy, stressing, however, the differentiated nature of the set of social practices identified as democratic that should be implemented in a dynamic densification called democratic in order to highlight the need toincrease opportunities for real participation and reset, ultimately, the state-civil society relationship in perspective both national and international and transnational. This process would contribute to a real potential for recognition and enforcement of human rights.Este trabalho buscará explicitar a complexidade de uma relação já muito difundida entre Direitos Humanos e Democracia, salientando, no entanto, a natureza diferenciada do conjunto de práticas sociais identificadas como democráticas que devem ser implementadas, em um dinâmica denominada de densificação democrática, a fim de revelar a necessidade de ampliação dos espaços reais de participação populare de redefinição, em última instância, da relação sociedade civil-Estado, em uma perspectiva tanto nacional, quanto internacional e transnacional. Este processo contribuiria para um potencial real de reconhecimento, e cumprimento dos Direitos Humanos
