Development of disparity ownership of land and building on it, in response to the new civil code no. 89/2012 coll.

The contribution gives a comprehensive overview of the disparity of ownership of buildings and land on it established , in particular, in the complex legislative developments in our country, from the beginning of its inclusion in the legislation , to the current changes in the newly enacted Civil Code as No. 89/2012. He becomes effective on 1. 1. 2014, and replaces the existing Civil Code No. 40/1964. The point is mentioned differences in the understanding of the building as part of the land on which the building was originally a completely part was subsequently applied contrary legal interpretation , lingering until now. Now the legislation goes back to completely original legal principle , the land surface subsides land and buildings are again becoming part of the land. Another part of the paper is devoted to the recitation of the relevant aspects related to the diversity of ownership as it brings the new Civil Code. This new regulation brings changes , which are also reflected primarily in valuation practice
