As part of their tenth programme of law reform, the Law Commission are currently undertaking a review of the law relating to intestacy and family provision. They published their consultation paper in October 2009 (Consultation Paper No 191, Intestacy and Family Provision Claims on Death) and their final recommendations are expected in 2011. This article reports on the key findings from a study funded by the Nuffield Foundation which was intended to provide up to date information for the Law Commission on public attitudes to how the law should distribute a person’s property when they die.
