The article is dedicated to the consideration of the phenomenon of guilt in the sphere of legal philosophy. The reasoning of the similar issue is fulfilled both synchronically and diachronically. In the synchronic field of research authors consider the specificity of guilt in the sphere of private law (civil law, commercial law) as such as in the region of public law (criminal law, administrative law). In the context of the diachronic research of the phenomenon of guilt authors turn themselves to the origin of the legal thought — legislation and legal philosophy of Ancient Greece (first of all, pre-Socratic philosophy of law — Parmenides, Heraclitus etc.) and Ancient Rome.
