Juger la folie : approche sociojuridique de la production du jugement pénal des auteurs d’infractions atteints de troubles mentaux (étude de cas dans le ressort du tribunal de grande instance de Vesoul, en 2012 et 2016)

The thesis proposes an analysis of the production’s mechanisms of the criminal court decision which inclines towards the offenders with mental disorders. The research concerns the study of 114 defendants who have been the subject of a judgment of Vesoul’s Criminal Court in 2012 or un 2016. Interviews were realized with stakeholders who participated in the production of the judicial decision (investigators, psychiatrists and magistrates). An immersion of several years in the field of the research allowed for direct observations of each procedure’s stages. The doctoral research starts from an observation: people mental disorders are overrepresented in prison while the law provides, perpetrators of offenses whose discernment was abolished at the material time are irresponsible. The purpose of this study is to identify offenders with mental disorders during the criminal procedure and the judicial treatment applied to them. The criminal decision law is understood as the product of a complex process; it is manufactured in several stages: the investigation, the psychiatric assessment, the decision to prosecute the defendant before the Court and the trial hearing. Each phase participates, in fact, in the decision final culpability, or acquittal, and if applicable to sentencing. The quantitative and qualitative analysis of the elements allows us to identify mechanisms for the identification of psychiatric disorders suffered by the perpetrator and to identify determinants of judicial decision. The study of psychiatric expertise and its apprehension by magistrates demonstrates a new function of the latter: humanizing uomo delinquente abstract and restore the man of flesh and blood. More than just assessment of the degree of responsibility or dangerousness of the perpetrator, the expertise Psychiatric involves the reconstitution of the social Being in his life’s trajectory. Expertise give access to the magistrate to a human part, while reinforcing their own convictions, which makes it possible to prevent a dehumanization of their function and to appease a possible “Anguish to judge”La thèse propose une analyse des mécanismes de production de la décision judiciaire pénale portant sur les auteurs d’infractions atteints de troubles mentaux. La recherche concerne l’étude de 114 prévenus ayant fait l’objet d’un jugement du tribunal correctionnel de Vesoul en 2012 ou en 2016. Des entretiens ont été réalisés auprès des acteurs participant à la production de la décision judiciaire (enquêteurs, experts psychiatres et magistrats) et une immersion de plusieurs années sur le terrain de recherche a permis des observations directes de chaque étape de la procédure. La recherche doctorale part d’un constat : les personnes atteintes de troubles mentaux sont surreprésentées en prison alors que la loi prévoit que les auteurs d’infractions dont le discernement était aboli au moment des faits sont irresponsables. L’étude a pour objet le repérage des auteurs d’infraction atteints de troubles mentaux au cours de la procédure pénale ainsi que le traitement judiciaire qui leur est appliqué. La décision pénale est appréhendée comme le produit d’un processus complexe ; elle est fabriquée en plusieurs étapes : l’enquête, l’expertise psychiatrique, la décision de poursuivre le prévenu devant le tribunal et l’audience de jugement. Chaque phase participe, en effet, à la décision finale de culpabilité, ou de relaxe, et le cas échéant à la détermination de la peine. L’analyse quantitative et qualitative des données nous permet de déceler les mécanismes relatifs à l’identification des troubles psychiatriques dont souffre l’auteur et de repérer des déterminants de la décision judiciaire. L’étude de l’expertise psychiatrique et de son appréhension par les magistrats démontre une nouvelle fonction de cette dernière : celle d’humaniser l’uomo delinquente abstrait et reconstituer l’homme de chair et de sang. Plus qu’une simple évaluation du degré de responsabilité ou de dangerosité de l’auteur des faits, l’expertise psychiatrique implique la reconstitution de l’Etre social dans sa trajectoire de vie. L’expertise donnent accès au magistrat à une part d’humain, tout en confortant leurs propres convictions, ce qui permet de prévenir une déshumanisation de leur fonction et d’apaiser une éventuelle « angoisse de juger
