Abstract: The National Credit Act 34 of 2005 ("the NCA") was introduced as a clean break from prior consumer credit regulation laws and seeks to regulate the unequal relationship between the consumer and a credit provider. The NCA comes with various socio-economic aims that seek to address the difficulties faced by many previously disadvantaged South Africans who were hindered from accessing the credit market.
