Interés Superior del Niño, Niña y Adolescente en Ecuador

The present investigation fulfilled the objective of analyzing and concretizing the principle of the best interests of the child through its interpretation, promoting its healthy application, avoiding the violation of the rights of children and adolescents in the Ecuadorian context. From the quantitative approach, through the search, collection and critical documentary analysis, bibliographic reference and studies or research projects. A bibliographic design of a documentary type, whose inquiry from critical reflection, the method of analysis of the phenomenon of study was built, considering laws, norms, agreements, international treaties. It is concluded that, although it has been materialized in the Constitution of the Republic and the Organic Code of Childhood and Adolescence, there is still a shortcoming in its practical materialization in social reality, this because this principle is not taken into account in all the spheres in which the child and adolescent find themselves.La presente investigación cumplió con el objetivo de analizar y concretizar el principio de interés superior del niño mediante su interpretación promoviendo su sana aplicación evitando la transgresión de los derechos de los niños, niñas y adolescentes en el contexto ecuatoriano. Desde el enfoque cuantitativo, a través de la búsqueda, recolección y análisis crítico documental, referencial bibliográfico y estudios o proyectos de investigación. Un diseño bibliográfico de tipo documental, cuya indagación desde la reflexión crítica, se construyó el método de análisis del fenómeno de estudio, considerando leyes, normas, acuerdos, tratados internacionales. Se concluye que, si bien se ha materializado en la Constitución de la República y el Código Orgánico de la Niñez y Adolescencia, aún existe falencia en su materialización práctica en la realidad social, esto debido a que este principio no es tomado en cuenta en todas las esferas en las que se encuentra el niño, niña y adolescente
