(Analysis Of Fiduciary Agreement Effectiveness After The Constitutional Court Verdict Number 18/ PUU-XVII/ 2019). The development of automotive business in Indonesia can be categorized quite rapidly. It is supported by the ease of access to the public to obtain credit ownership of motorists. The finance institution grows and develops throughout the area with a variety of lucrative motor vehicle credit programs. But not all of these credit programs run smoothly. There are many disputes that occur between debtors and lenders that are generally caused by outstanding credit payments. In anticipation of the possibility of a dispute, the creditor party tied a credit transaction in fiduciary agreement. This writing aims to provide an analysis of the legal guarantees set out in the fiduciary agreement and the effectiveness of this fiduciary agreement provides legal protection against creditors. The results of the research are expected to be legal reference for the public, especially the creditors and debtors so as to strengthen the legal guarantees against both parties. The method of approach used is the normative and descriptive juridical approach. This research uses secondary data obtained from primary and secondary legal materials. The results showed that there were weaknesses in the fiduciary agreement that made this agreement less effective in providing legal guarantees especially for the creditors, even after the issuance of the verdict of the Constitutional Court in 2019.Perkembangan bisnis otomotif di Indonesia dapat dikategorikan cukup pesat. Hal ini didukung oleh makin mudahnya akses masyarakat untuk mendapatkan kredit kepemilikan kendaraan bermotor. Lembaga finance tumbuh dan berkembang di seluruh daerah dengan berbagai program kredit kendaraan bermotor yang menggiurkan. Namun tidak semua program kredit ini berjalan lancar. Ada banyak sengketa yang terjadi antara debitur dan kreditur yang umumnya disebabkan oleh pembayaran kredit yang tertunggak. Untuk mengantisipasi kemungkinan terjadinya sengketa, Pihak Kreditur mengikatkan transaksi kredit dalam perjanjian fidusia. Tulisan ini bertujuan untuk memberikan studi analisis tentang jaminan hukum yang diatur dalam perjanjian fidusia dan seberapa efektiv perjanjian fidusia ini memberikan perlindungan hukum terhadap kreditur. Hasil penelitian diharapkan dapat menjadi referensi hukum bagi publik, terutama pihak kreditur dan debitur sehingga dapat memperkuat jaminan hukum terhadap kedua pihak. Metode pendekatan yang digunakan adalah pendekatan yuridis normatif dan bersifat deskriptif analitis. Penelitian ini menggunakan data sekunder yang diperoleh dari bahan hukum primer dan sekunder. Hasil penelitian menunjukkan adanya kelemahan-kelemahan dalam perjanjian fidusia yang membuat perjanjian ini kurang efektiv dalam memberikan jaminan hukum terutama untuk pihak kreditur, bahkan pasca terbitnya Putusan dari Mahkamah Konstitusi Tahun 2019
