A CONDUÇÃO EFICIENTE DE UM PROCESSO ADMINISTRATIVO DISCIPLINAR COMO APOIO À GESTÃO PÚBLICA

The article under an opinion of studies to elucidate issues related to the Disciplinary Administrative Process (PAD), and the existing difference with the Inquiry instrument, to highlight the administrative procedure as an act that incorporates enforcement instruments and punishments to employees and public servants who may incur any infractions, interfering in the negative way when exercising their loads. The resolution of the project, in turn, shows a research to analyze the importance, importance and legal basis of the administrative instruments, considering the current legislation, the jurisprudence and the corresponding doctrines, in order to avoid formation of processes that present defects and nullities, being called unnecessary for public management. Consequently, the study obtained as a result of the characterization of figures that, from different aspects, compete for the criminal fault, using the resources, as a way to ascertain the evidence of the practice committed by each public servant. Thus, in line with the Democratic Rule of Law, or with the applied criterion, it will be the deductive method and the hermeneutic dialectic, initiating a generalization for a particular issue, with the intention of considering as social practices, in the Administrative-Legal scope, with an end of use the means that are worth to the Public Administration, to stigmatize its administrators.O artigo sob a égide de estudos visa elucidar questões pertinentes ao Processo Administrativo Disciplinar (PAD), e a disparidade existente com o instrumento da Sindicância, a destacar o procedimento administrativo como um ato que incorre em instrumentos para realização de apurações e punições aos funcionários e servidores públicos que possam incorrer em eventuais infrações, interferindo de forma negativa ao exercício de seus cargos. A resolução do projeto, por sua vez, caracteriza-se na busca de uma análise de eficácia, importância e fundamento jurídico dos referidos instrumentos administrativos, considerando as legislações vigentes, jurisprudências e doutrinas correspondentes, de forma a evitar formações de processos que apresentem vícios e nulidades, sendo-os denominados desnecessários à gestão pública. De modo decorrente, o estudo obteve como desenlace a caracterização de figuras que, de diferentes aspectos, competem para a falta criminosa, utilizando dos recursos (PAD/Sindicância), como forma de apurar os indícios da prática cometida por cada servidor público. Destarte, em consonância com o Estado Democrático de Direito, o preceito aplicado será o método dedutivo e a hermenêutica dialética, partindo de uma generalização para uma questão particularizada, com o intuito de considerar as práticas sociais, no âmbito Administrativo-Jurídico, a fim de explorar os meios que se valem a Administração Pública, para estigmatizar seus administrados
