ANALISIS PERTANGGUNGJAWABAN PIDANA TERHADAP PELANGGAR LALU LINTAS YANG MENIMBULKAN KECELAKAAN BERAKIBAT KEMATIAN (Studi di Polres Kota Malang)

Criminal liability shall be committed by any person who commits an offence or criminal acts. One of the parties that can be held criminally accountable is traffic offenders. There are many traffic violations that occur every day and trigger traffic accidents. Traffic accidents that occur result in a lot of risks for everyone who experiences it. The risk can be minor injuries, severe injuries and even the most dangerous is death. The purpose of this writing is to know and analyze related criminal liability to traffic offenders who cause accidents resulting in death as well as to know the efforts made by the traffic violation’s police of Malang City in resolving traffic accidents resulting in death. The method used in this writing is sociological juridical by conducting interviews with related parties as well as documenting and collecting literature study materials. The conclusion and suggestion of this paper is that criminal liability for traffic offenders who cause accidents resulting in death is always carried out in accordance with applicable law and based on the provisions of Article 310 paragraph (4) of The Constitution Republic Indonesia number 22/2009 about the Traffic and Road Transport. In relation to these traffic accidents, the police also made some very effective efforts considering the number of accidents continues to decrease every year. The advice given is so that the whole community can further increase its legal awareness to better comply with the traffic regulations that have been made to reduce the number of traffic accidents
