Tinjauan Hukum Terhadap Pelaku Pencemaran Nama Baik Dalam Perspektif Hukum Pidana (Studi di Polres Banjarbaru Kalimantan Selatan)

The purpose of this study is so find out the determine the regulations and the application of crimes against perpetrators of defamation according to the Criminal Code, the ITE Law and also according to Islamic criminal law. The research was conducted at the Banjarbaru Police, South Kalimantan. This study uses a qualitative analysis method. The results showed that: The criminal law regulations against the perpetrators of defamation in the Banjarbaru Police, South Kalimantan, refer to two legal regulations, namely the Criminal Code and the ITE Law. The application of crimes against the perpetrators of defamation at the Banjarbaru Police, South Kalimantan is still in accordance with what is regulated in the Criminal Code and the ITE Law, but the course is different from the articles that regulate it. Because, the application of law for perpetrators of defamation whether done verbally, in writing or with pictures, whether done online or offline, the case is resolved first by familial or mediation with restorative justice (Restorative Justice). And the rules of criminal sanctions against the perpetrators of defamation according to Islamic criminal law are in the form of ta'zir punishment
