PROSES PENYIDIKAN TINDAK PIDANA KEPEMILIKAN SENJATA API SECARA ILEGAL OLEH WARGA SIPIL (STUDI KASUS DI POLRESTA MALANG KOTA)

The case of possession of illegal firearms by civilians is a serious problem, if it is not handled quickly and appropriately it will become a big problem. Indonesia is actually a country that is quite strict in implementing illegal firearms ownership rules for civilians, in terms of misuse of possession of firearms it has been regulated based on Emergency Law Number 12 of 1951. Problems in this legal research in the investigation process there are still things that investigators have not been able to fulfill and implement it as is the case, the most common thing is that investigators still have difficulty tracing the history of firearms, starting from where the firearms were first produced, to whose first owner was. The purpose of this study was to determine a series of investigators' actions in the direct field (TKP) regarding the criminal acts of illegal possession of firearms by civilians in Malang City Police. The method used in this research is sociological juridical method, namely a case study in Malang City Police. The results of the research show that there are reports from the public regarding the possession of illegal firearms, however, the police are still less proactive and responsive because they are only waiting for reports from the public, then in conducting patrols the police have not been maximal and lack of initiative, in terms of collecting evidence there are still gaps, namely Because there is preliminary evidence that the police can act arbitrarily, and find the suspect related to DPO, the lack of an internal inter-regional police network so that in this case the police at Malang City Police in searching for DPO suspects are still difficult to find. Suggestion, the police in Malang City Police should further increase supervision and control of the use of firearms in civil society
