El perito de confianza de los jueces.

The court appointed experts offer many advantages that could be heightened if greater attention is given to its proper selection and the criteria thereby involved, apart from his/her mere impartiality. Unfortunately, today’s legal judicial systems have been focusing exclusively on the institutionalization of the expert, even justifying on this ground only the use of specialized information to make judicial decisions. The aim, here, is to develop a theoretical framework giving substantial content to what might be the peculiar trait of such expert evidence: its selection based on epistemologically adequate criteria.El llamado perito oficial o perito del juez ofrece varias ventajas que pueden ser aprovechadas si se presta mayor atención a la propia selección del experto (y los criterios en tal tarea implicados) que conocerá de las necesidades epistémicas del caso, más allá de su mera imparcialidad de origen. Desafortunadamente los sistemas jurídicos actuales han tendido a una mera institucionalización del perito oficial, algunas veces incluso usando ésta como única justificación para el uso de información especializada como fundamento de sus decisiones.
