Kedudukan hukum perma RI nomor 1 tahun 2016 tentang prosedur mediasi dalam pemeriksaan perkara perdata di pengadilan

Abstractmediation is an obligation in the trial. Judges of court cases require parties to mediate as mandated by the provisions of article 130 HIR (154 RBg) for a period of 30 days and can be extended for 30 days from the date of stipulation. if the parties are present in the mediation process and make a selection of mediators, the parties with the help of the mediator conduct the mediation process. In the implementation of mediation there are 3 possibilities that can occur, namely mediation reaching an agreement, reaching a partial agreement, and not being reached at all. The role of the mediator is important in the continuation of mediation, mediators are judges or other parties who have mediator certificates. Such certificates are obtained from mediator specific training but certified mediators in Indonesia are still low so that judges can function as mediators. besides that the parties can be accompanied by legal counsel, this can affect the course of mediation, especially for lawyers who pursue prefional fees, or in other words seek profit. Then the provisions in the mediation program still have confusion that is difficult to understand. so that the need for the development of certified mediators, the obligation to attend without legal counsel and procedures that are easy to understand
