Interruption volontaire de grossesse : quelle prise en charge pour les femmes hors délai ?

Decriminalizing abortion, the Veil Law was passed in 1974. But nearly fifty years after this major breakthrough -acknowledging the right to abortion-, a good number of French women still have to go abroad in order to get an abortion after the legal time limit. And those who cannot afford it do not have the option to end their pregnancy.This dissertation intends to reflect on the many ethical issues raised by these facts, and to ask the following question: how to deal with requests for termination of pregnancy coming from women who are already beyond the legal time limit?Analyzing the medical files of nineteen patients who have undergone therapeutic abortion for psycho-social reasons at the Saint-Denis hospital (France) has enabled us to bring to light the complexity of certain situations, clearly indicating that to certain women in specific circumstances, the legal time limit of 14 weeks of amenorrhea is not enough.It then becomes logical to question the grounds of the current legal limit by looking into the ethical stakes involved in an extension or a withdrawal of this limit. The support of the medical staff faced with this kind of individual procedure plays a key role in the positive response to late requests for abortion. This support can be gained through training courses and the development of a reassuring frame able to soothe fears, particularly the fear of a raise of abortion numbers and of the rise of litigious patterns of practice and requests. Finally, one of the other issues that help fuel the misgivings about a limit extension is the fetus's status. So, it appears necessary to seek ways to implement fairer, more realistic and more sustainable solutions.En 1974, la loi Veil dépénalisant l'avortement est votée. Mais près de cinquante ans après cette avancée majeure en terme de reconnaissance du droit à l'avortement, de nombreuses Françaises se retrouvent encore à devoir partir à l'étranger pour avorter une fois le délai légal passé. Et pour celles qui n'en ont pas les moyens, quel autre choix alors que de poursuivre leur grossesse ?Ce constat soulève bon nombre de questionnements éthiques et ce mémoire propose d'y réfléchir en énonçant la problématique suivante : quelle prise en charge pour les demandes d'interruption de grossesse chez les femmes hors délai ?L'analyse de 19 dossiers de patientes ayant eut recours à une interruption médicale de grossesse (IMG) pour motifs psycho-sociaux à l'hôpital de Saint-Denis a permis de mettre en lumière la complexité de certaines situations, exposant clairement que pour certaines femmes dans certains contextes le délai de 14 semaines d'aménorrhée n'est pas suffisant.Il devient alors naturel d'interroger les fondements du délai actuel en s'intéressant aux enjeux éthiques soulevés par un allongement voire une suppression du délai. L'adhésion des soignants à la démarche est un des points clé de la prise en charge des demandes tardives d'interruption de grossesse. Elle passe par la formation et la mise en place d'un cadre rassurant pour apaiser les craintes, notamment d'une augmentation du nombre d'interruptions de grossesse ou de dérives. La question du statut du fœtus est également un enjeu qui contribue à alimenter les réticences à un allongement du délai. Au vu de ces éléments, il convient de réfléchir rapidement à la mise en place de solutions plus justes, réalistes et pérennes
